That's another reason a court may require a bond. We had a case in Bronx County where the sister claimed to be the sole distributee (heir). We represented a nephew (a child of the predeceased brother) whom she omitted from her papers. We got her removed as administrator and our client appointed as administrator. It turned out that she took all the assets, so we went after the bonding company. One of the court attorney said that they've seen this before and for that reason they require a bond when someone claims to be the sole distributee (heir) in an intestate estate....
