would it be legal for:
spouse has HSA and will have one in 2025 with a HDHP through spouse's employer
In 2025, I do not cover my spouse through my own employer's health plan, but I do elect to do an FSA for spouse in 2025 with money for that being deducted from my salary.

Would that be legal?
If your spouse is covered by your FSA then they wouldn't be HSA eligible. It doesn't matter whether they are covered by your insurance or not, the FSA coverage is what counts.

So I don't think your plan above will work.
