Rental car companies will often waive the loss of use charges when they deal with an insurance company.My experience with AMEX Premium was different several years ago. Yes, Avis wanted LOU and would not provide logs. AMEX handled it all, told me not to pay anything or interact with AVIS and eventually (15 months?) got a release from AVIS.

However, if the rental car company doesn't waive the charge, then you're stuck. American Express won't pay without a fleet log, and the rental car company will not release the fleet log.
The risk is higher during peak season and in foreign countries. The risk is lower off-peak and in the United States and Canada.
